As the door slowly closes on Article 13 health claim submissions, I believe those companies that have not invested in the process, or composed dossiers in-house will fall short on approvals. There is already much discussion of submissions using websites as evidence and medicinal claims and or patient based studies to back non-medicinal products. This will surely play out well for EFSA as these submissions will quickly be discarded cutting down on the vast number they have already received.
He went onto comment further...
It will only be in 2009 / 2010 when these companies will come searching for experts in regulation to help them resubmit their. Many will and should submit via article 18 which will be into effect in Jan 2008 according to sources within the EU commission. The article 18 route will afford some novel and well deserved protection for product claims from those investing wisely in science and expert submission services.
